General Terms and Conditions
§1 - Formation of the contract
(1) Registration requires, without exception, a minimum age of 18 years and liability insurance valid for the duration of the event and customary in Germany. By submitting the registration form, the participant assures that he/she has taken out such liability insurance and is obliged to provide proof of this upon request by the organizer.
(2) The contract is concluded by the binding registration via the organizer's website and the confirmation of registration by the organizer. Complete registration includes the payment of the participation fee within 14 days of the organizer sending the account details and the sending of the character description, if the latter was requested with the registration. If the organizer does not respond to the participant's registration within 14 days of sending the registration on the website, the participant is no longer bound by his/her registration.
§ 2 - Rules and regulations
When registering, the participant must provide the game management with a character description. This must correspond to the rules system specified by the organizer; the game is played on the basis of the Drachenfest rules and, in addition, DKWWDK ("You can do what you can represent"). By registering, the participant accepts the rules system (including rule modifications) specified by the organizer as binding for the game. The game management is entitled to decide on binding rule changes even after the contract has been concluded. If no character description is made known to the organizer at the time of registration, or if a character description is changed in essential parts after registration and the character is therefore no longer playable within the framework of the organizer's rule system, the participant has no right of withdrawal.
§ 3 - Safety
The participant assures that he/she is able to take part in the event, taking into account the expected physical, mental and emotional strain. The participant is aware of the risks and the nature of the event when registering. If the expected stresses and strains are not apparent from the enclosed information material, the organizer can provide further information in case of doubt. The organizer reserves the right to subject the participant's equipment to a safety check. Objectionable items may not be used in the game. These will be marked with the player's name by the organizer/game management and kept until the end of the event. This includes padded weapons, arrows/bolts etc. as well as armor. Failure to do so may result in exclusion from the event. The participant is obliged to check his equipment (in particular the padded weapons and armor used by him) for safety during the event on his own responsibility. If they do not or no longer comply with the safety regulations, they must take them out of use themselves by handing them over to the organization/game management for safekeeping until the end of the event. The participant undertakes to avoid any dangers to himself, other participants and the environment that go beyond the normal risk of live role-playing. In particular, this includes
Climbing on unsecured steep slopes and walls, as well as the lighting of open fires or pyrotechnic effects outside of designated locations approved by the organizer. Anyone who has consumed alcohol or taken medication to an extent that makes it illegal to drive a vehicle on public roads must refrain from fighting of any kind and from physically dangerous exercises. Violations will result in immediate exclusion from the game. Bringing and consuming drugs of any kind is strictly prohibited. The instructions of the organizer and its vicarious agents must be followed. Participants who violate the safety regulations or fail to follow the instructions of the organizer in a serious manner or repeatedly may be expelled from the event without the organizer being obliged to refund the participation fee.
§ 4 - Liability
With the exception of injury to life, limb or health, the liability of the organizer is limited as follows: The organizer shall only be liable for damages resulting from an intentional or grossly negligent breach of duty by the organizer, a legal representative or vicarious agent of the organizer. Claims for damages arising from impossibility of performance, breach of duty and default are limited to compensation for foreseeable damage in cases of slight negligence.
§ 5 - Copyright and recordings
All rights to audio, film and video recordings made by the organizer are reserved by the organizer. The organizer is entitled to record the entire event or parts thereof and to use these recordings for the purposes of self-promotion. By participating, the participant agrees to this use.
All rights to the ensemble of terms, proper names and non-player characters used by the organizer in connection with the dragon festival conceived by Wyvern e. K. are reserved by Wyvern e. K.. All rights to the listed plot, as well as the ensemble of terms, proper names and non-player characters used by the organizer, which are not in connection with the dragon festival conceived by Wyvern e. K., are reserved by the organizer. The organizer makes these available to Wyvern e. K. for use free of charge until further notice. The rights to the player characters, their story and their part of the plot remain with the respective player.
Recordings made by participants are permitted for private purposes. Any public performance, transmission or reproduction of recordings, even after editing, is only permitted with the written consent of the organizer.
§ 6 - Withdrawal, non-acceptance of registration, exclusion from the event
The number of participants is limited. Places are not transferable. In the event of withdrawal, the organizer will attempt to allocate the place to another participant. The organizer reserves the right to exclude participants from the event prior to the event without giving reasons and against reimbursement of the participation fee.
Refunds can only be made if the organizer is able to fill the participant's place again.
§ 7 - Financial matters
(1) Payment of the participation fee shall always be made in advance by bank transfer to the bank details provided by the organizer. If the participation fee has not yet been paid in full, the registration shall be deemed incomplete. The participation fee must be transferred within 14 days of the organizer sending the account details, otherwise the registration shall be deemed invalid. In the case of registrations in the name and for the account of a third party, the registrant shall be jointly and severally liable for the latter's obligations arising from this commitment.
(2) Insofar as the organizer offers discounted 'social tickets', this is an offer to which the participants have no right to claim. They can only be used after written consultation with the organizer. The social ticket discounts are realized by voluntary overpayment of the ticket prices of the participants and can therefore only be issued in the amount and number depending on this overpayment. If overpayments are made without the social tickets being used, the participant agrees with payment that the overpaid amount will be booked to p.i.p. e. V. as a donation.
§ 8 - NSC clause
The NPC is bound by the instructions of the game management. He must follow their instructions. NPCs who are expelled from the event for reasons set out in §3 may be held liable for the full amount of the costs incurred in addition to their participation fee.
§ 9 - Discounts
If participants are granted discounts from the usual participant fee for the performance of certain functions, the difference shall be deemed deferred until the agreed service has been provided to the agreed extent. Discounts for paramedics are expressly excluded from this regulation. If the participants are unable to provide the agreed service for a reason for which the organizer is responsible, the discount shall nevertheless remain in force.
§ 10 - Miscellaneous
If one or more provisions of the General Terms and Conditions are or become invalid, this shall not affect the validity of the contract and the remaining General Terms and Conditions and provisions. In the event of the invalidity of individual provisions, the provision that comes closest to the original provision in economic terms and is legally permissible shall apply. Amendments, changes, cancellations and subsidiary agreements of any kind must be confirmed in writing by the organizer in order to be legally valid. The general terms and conditions of the organizer and the law of the Federal Republic of Germany shall apply; the place of performance and jurisdiction shall be the registered office of the organizer.
